Jury Finds Boone Resident Guilty Of Operating Under the Influence

BOONE, Iowa—Last week, a jury at the Boone County Courthouse found 56 year old, Kari Lee Fogg, Boone, Iowa, guilty of Operating While Intoxicated.  Because this is Kari Fogg’s first conviction she will face up to one year in jail and a $1,250 fine.

According to a release from the Boone County Attorney’s office, the jury trial was heard in the Boone County District Associates Court on February 13th and 14th.  At trial an officer with the Boone Police Department testified that on October 10, 2017, he was on patrol in a residential neighborhood at approximately 9:50 pm.  While on patrol he saw a silver Hyundai driving very slowly, at 10 mph through the streets.

The vehicle pulled into an alley rarely used for traffic and then it parked mid-block.  The officer checked on the driver who was identified as Kari Fogg.  Fogg told the officer that she lived in the area and was checking out the alley because it was not straight.  While speaking with Fogg the officer could smell a strong odor of an alcoholic beverage coming from her.  He also noticed her eyes were red and watery and her speech was slightly slurred.  These are all signs and symptoms of someone under the influence of alcohol or drugs.  He asked Fogg if she had been drinking, at first she denied but when asked again she stated she only drank two glasses of wine.  Field sobriety tests were administered at the scene.  Kari Fogg was able to perform some of the tests and other tests she could not understand the instructions.  Based on the observations at the scene and the field sobriety tests the officer concluded that Kari Fogg was Operating While Intoxicated.  At the jail Fogg refused to take the breathe test.  Kari Fogg testified at trial that she took medication with two glasses of wine that is why she appeared intoxicated. On cross examination she provided the medication bottle which warned people taking the medication right before bed.  At the end of the trial the jury found the Kari Fogg guilty of Operating While Intoxicated.

Sentencing on the case will be held at a later date.

The Boone Police Department investigated the case.  The Boone County Attorney’s Office represented the State.  Kari Fogg was represented by a local attorney.
