BOONE, Iowa—A 56-year old West Des Moines, Iowa man has been sentenced to 5 years in prison for a probation violation case. Randy Drake was sentenced earlier this month in Boone County District Court. Drake was on probation after he pled guilty to a charge of Theft in the Second Degree, a Class D Felony.
According to the Certificate of Probable Cause filed with the Court, that on October 25, 2012, Randy Drake took $1,750 in currency from the Boone Recovery Prevention Center. On January 22, 2013, Randy Drake, pled guilty to the charge of Theft in the Second Degree in violation of Iowa Code 714.1 and 714.1(2), a class D Felony. On March 15, 2013, Randy Drake received a sentence of two to five years probation and a fine of $750.
A Probation Revocation Hearing was heard in the District Court on April 15, 2014. The State was represented by Kailyn Heston with the Boone County Attorney’s Office. After a hearing, the court found that Randy Drake violated the terms of his probation. The Boone County Attorney’s Office made the recommendation to revoke Randy Drake’s probation and for the court to sentence him to five (5) years in prison. The court did sentence Randy Drake to five (5) years in prison with the Iowa Department of Corrections.
